Emissoras que descumprirem a regra estão sujeitas a pagar multa
De acordo com o calendário das Eleições 2020, a partir desta terça-feira (30), emissoras de rádio e televisão não podem transmitir programa apresentado ou comentado por pré-candidatos.
Esse prazo é fixado pelo calendário vigente. Entretanto, o Tribunal Superior Eleitoral (TSE) destaca que o Congresso Nacional discute uma Proposta de Emenda à Constituição (PEC) sobre a possibilidade de adiamento das eleições devido à pandemia causada pelo novo coronavírus, e que outras datas podem ser afetadas.
Eventual descumprimento da regra prevista na Lei das Eleições (Lei nº 9.504/1997) pode acarretar multa à emissora e cancelamento do registro de candidatura dos envolvidos. Tais sanções podem ser aplicadas pelo juiz eleitoral, caso o pré-candidato seja escolhido em convenção partidária.
A proibição vale tanto para a programação normal das emissoras quanto para o noticiário, ou seja, ainda que sob a forma de entrevista jornalística em que seja possível identificar o entrevistado. A norma proíbe difundir opinião favorável ou contrária a candidatos, partidos ou coligação, para garantir uma disputa equilibrada.
